The IRS issued revisions to the regulations under section 6323 on April 4, 2011, for NFTLs filed on or after that date. Most of the revisions impact the refiling of the NFTL and these revisions receive special note. The primary regulations governing section 6323 had not been updated since 1976 which was before the Service adopted self releasing liens and before several other revisions to section 6323. Be aware of these changes to the regulations when researching a specific NFTL issue.

The IRS has the ability to take a taxpayer’s property, or rights to property, and sell it to satisfy unpaid federal taxes. The IRS prefers to take property and sell it over bringing a suit to foreclose the lien because the administrative taking and selling the property is much easier and faster. In certain situations, however, a cloud exists on the title to property making it difficult to get a decent price if the property is seized and sold administratively. In those situations, the IRS will refer the matter to the Tax Division to have a suit brought foreclosing the lien on the asset. The process of lien foreclosure also serves to quiet the title to the property, allowing the Government to sell the property at a much higher price than it would receive with an administrative sale.

A lien foreclosure action requires all parties with an interest in the property to be joined in the action. Locating and serving everyone with an interest can be a difficult chore. Prior to bringing a lien foreclosure action, the IRS will generally try to convince the taxpayer to sell the property to save the time and cost of the suit. If the IRS brings a foreclosure action and does not anticipate that foreclosure on the property at issue will fully satisfy the liability, it will usually seek to reduce the liability to judgment at the same time.

How tо Rеlеаѕе оr Remove a Lіеn

The release оf a fеdеrаl tаx lіеn is ѕubjесt to three major conditions: уоur dеbt is раіd in full, bоnd guarantees рауmеnt about уоur dеbt, аnd thе period оf соllесtіоn hаѕ еndеd (Publісаtіоn 594, “Rеаѕоnѕ We’ll ‘Release’ a Fеdеrаl Tаx Lien,” 6/4/2013). Thе rеlеаѕе оf thе lien means that the IRS hаѕ cleared bоth thе lіеn fоr your dеbt аnd thе рublіс Nоtісе of Federal Tаx Lien. Thе IRS wіll fіlе a Cеrtіfісаtе of Rеlеаѕе of Fеdеrаl Tаx Lien wіth bоth ѕtаtе аnd local аuthоrіtіеѕ.

Thеrе аrе аddіtіоnаl орtіоnѕ for rеlеаѕіng аnd having a lіеn released. If the lіеn wаѕ filed durіng a bankruptcy automatic stay period, the lien mіght be rеlеаѕеd. Lastly, if іt іѕ in уоur best іntеrеѕtѕ and thе іntеrеѕtѕ оf the gоvеrnmеnt, the IRS mау rеlеаѕе a lіеn.

Withdrawal and removal of tax liens NFTL

Withdrawal of the NFTL came into existence in 1996 in response to concerns raised by taxpayers that the NFTL filed by the IRS created substantial hardships and an acknowledgment that sometimes not filing the NFTL served all parties. Prior to 1996 even if a taxpayer could convince the IRS that the NFTL had a negative impact, the IRS had no mechanism for taking back its action of filing the NFTL. Withdrawal, and removal provided for in section 6323(j), now gives the IRS the option to take back the filing of the NFTL. Convincing the Service to exercise that option requires good advocacy skills. Withdrawing the NFTL does not eliminate the FTL. Withdrawing the NFTL simply removes the notice of the FTL from the public record. The taxpayer still owes the tax. The FTL still attaches to all property and rights to property of the taxpayer. If the taxpayer still owes the debt and the FTL still attaches to all of the taxpayer’s property, what is the benefit of withdrawing the NFTL? Several benefits exist for the taxpayer and detriments can exist for the Service. The decision to withdraw requires a balancing of interests and an analysis of the underlying facts. Simply filing the NFTL and leaving it in existence is the easiest option for the Service. Working through the statute to determine if the taxpayer’s circumstances warrant withdrawal requires effort and judgment. Taking the Service to the point of a favorable decision requires skill and knowledge of the statutory provisions for withdrawal. The decision to withdraw the NFTL rests with the Service. Section 6323(j) states that the Secretary “may” withdraw the NFTL if the Secretary determines that one of four circumstances exist. The discretion to withdrawal resembles the discretion given to the Service to determine whether to accept an offer in compromise. Section 7122 states the Secretary “may” compromise a tax debt. Both decisions occur without judicial review except under the limited circumstances of collection due process cases.
